Agreement to terms
By creating an account or using SchoolBoardHQ, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you and SchoolBoardHQ.
Eligibility
SchoolBoardHQ is intended for current and recently serving K-12 school board members in the United States. By creating an account, you represent that you are or were a school board member, an authorized district representative, or an individual otherwise eligible to participate in school board governance discussions. You must be at least 18 years old to use this service.
Account responsibilities
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at support@schoolboardhq.com if you suspect unauthorized access to your account.
Acceptable use
You agree to use SchoolBoardHQ for lawful board governance work and professional networking. You may not:
- Upload unlawful, defamatory, or harassing content.
- Share confidential student records (Family Educational Rights and Privacy Act (FERPA)-protected), personnel files, protected health information, attorney-client communications, executive-session material, or any other information your district or the law requires you to keep non-public.
- Post legal conclusions or advice as though SchoolBoardHQ approved or verified them.
- Attempt to access other users' accounts or private data.
- Reverse-engineer, decompile, or disassemble any part of the platform.
- Use automated tools, bots, or scrapers to extract data.
- Send spam, chain messages, or unsolicited bulk communications.
- Impersonate another person or misrepresent your board affiliation.
Content ownership and license
You retain ownership of content you create on SchoolBoardHQ. By posting content, you grant us a limited, non-exclusive, royalty-free license to display, store, transmit, and format it as needed to operate and improve the service. This license ends when you delete the content or close your account, except where retention is required by law.
District-related governance content may be subject to applicable public records and open meetings laws. You are responsible for ensuring your use of the platform complies with your district's policies and applicable law.
Public records and open meetings
As a platform for public officials, SchoolBoardHQ recognizes that some communications may be subject to state public records or open meetings laws. We do not provide legal advice on whether specific content is a public record. You are responsible for understanding and complying with your state's requirements. If your district receives a public records request that includes SchoolBoardHQ communications, we will cooperate with reasonable, lawful requests for data.
Moderation and enforcement
We may review, remove, or restrict content or accounts that violate these terms. Enforcement actions are proportional and may include:
- A warning with an explanation of the violation.
- Removal or restriction of specific content.
- Temporary suspension of account access.
- Permanent account termination for severe or repeated violations.
We aim to notify you before or promptly after enforcement, except in cases of imminent harm, legal obligation, or active security threats. You may appeal enforcement decisions by emailing support@schoolboardhq.com within 30 days of the action.
Account termination
You may delete your account at any time through the app settings or by contacting support@schoolboardhq.com. Before deletion, you may request an export of your personal data.
We may suspend or terminate accounts for:
- Violations of these terms.
- Extended inactivity (12+ months with no sign-in).
- Legal or regulatory requirements.
Upon termination, your profile and messaging data will be deleted within 30 days, subject to legal retention obligations described in our Data Policy.
Intellectual property
SchoolBoardHQ, including its name, logo, design, software, and documentation, is the intellectual property of SchoolBoardHQ and is protected by applicable copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our platform without prior written permission.
Service availability and changes
We strive to keep SchoolBoardHQ available and reliable, but we do not guarantee uninterrupted access. We may update, suspend, or discontinue features to address misuse, security risks, legal compliance, or platform reliability needs.
For material changes that reduce existing functionality, we will provide at least 14 days' notice via in-app notification. Emergency changes for security or legal reasons may take effect immediately.
Limitation of liability
SchoolBoardHQ is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, SchoolBoardHQ and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total aggregate liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
Indemnification
You agree to indemnify and hold harmless SchoolBoardHQ, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
Dispute resolution
We encourage resolving disputes informally first. If a dispute arises:
- Contact us at support@schoolboardhq.com to attempt good-faith resolution.
- If unresolved within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, conducted in English in the state of Washington.
- You may opt out of the arbitration requirement by sending written notice to support@schoolboardhq.com within 30 days of account creation.
Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations or security breaches.
Governing law
These terms are governed by the laws of the State of Washington, excluding conflict-of-law rules, except where mandatory local law requires otherwise.
Accessibility commitment
We are committed to making SchoolBoardHQ accessible to all users, including those with disabilities. We design with Web Content Accessibility Guidelines (WCAG) 2.1 AA standards in mind and welcome feedback on accessibility. If you encounter an accessibility barrier, please contact support@schoolboardhq.com so we can address it.
Policy updates
We may update these Terms of Service as our platform evolves or as required by law. Material changes will be communicated via in-app notification at least 14 days before taking effect. Continued use of SchoolBoardHQ after the effective date constitutes acceptance of the updated terms. The "Effective" date at the top of this page indicates the current version. Previous versions are available upon request.
